Abstract

Le droit et le non-droit: alcune osservazioni nell?ottoca del diritto Anglosassone (di John Bell) - ABSTRACT: Il lavoro di Jean Carbonnier sulla sociologia del diritto fornisce un punto d?incontro tra la tradizionale sociologia teoretica francese e la tradizione empirica anglo-americana. L?autore dimostra l?autore dimostra una buona conoscenza della letteratura anglo-americana, specialmente nel suo saggio Sociologie juridique, edito a Parigi nel 1878. Il concetto di non-droit offre un?aperta sfida all?assunto che il diritto, in teoria se non anche in pratica, debba governare tutto. Secondo Carbonnier il non-droit ? il fondamento del diritto in un vasto numero di relazioni interpersonali dove ci si aspetterebbe che esso sia teoricamente presente. Per i giuristi il non-droit ? un fenomeno secondario, di poca importanza. Carbonnier evidenzia come abbiamo bisogno di capire quale sia il posto del diritto nella vita della gente che fa uso del diritto.
