Abstract

Perch? un codice non ? il modo migliore per portare avanti le ragioni dell?unit? giuridica europea (di Basil S. Markesinis) - ABSTRACT: Markesinis, partendo da una precisa ricostruzione storica, sostiene che l?ideologia della codificazione sia definitivamente superata. Nello scritto, che si sostanzia nell?intervento al convegno di Roma del 10 luglio 1999 sul Progetto di studio sul codice europeo, vengono evidenziati importanti aspetti pratici che ostano alla realizzazione di un codice europeo, primo fra tutti la chiusura dei giuristi interni ad imposizioni che snaturerebbero la fisionomia di istituti giuridici radicati da tempo. Nondimeno, l?Autore propone mezzi alternativi per cercare di creare una civilt? giuridica europea: innanzi tutto le direttive comunitarie, secondariamente il lavoro unificatore della dottrina; infine, Markesinis auspica l?intensificarsi di "migrazioni" di studenti e professori, che contribuiscano a far circolare le idee giuridiche dei singoli paesi.
