The Composition of Interests in Gmos Discipline in the EU and China Legal Orders: A Comparative Approach

Abstract

L?articolo analizza la composizione degli interessi nella disciplina degli Organismi geneticamente modificati (Ogm) in Cina e nell?Unione europea. Gli autori evidenziano i differenti obiettivi perseguiti dai legislatori in questa materia: da un lato, gli interessi commerciali e allo sviluppo economico, dall?altro la tutela della salute e la protezione dell?ambiente. Nella prima parte viene illustrato come questi interessi, teoricamente in conflitto, sono combinati dal legislatore cinese; nella seconda parte, invece, si descrive la relazione tra questi obiettivi perseguiti nel diritto dell?Ue, attraverso l?analisi della normativa e della giurisprudenza rilevanti. Nella parte finale dell?articolo, attraverso un?analisi comparatistica, sono illustrate le conclusioni della ricerca.
