Mutual funds as a legal instrument of risk management in agriculture

Abstract

L?obiettivo dell?articolo ? quello di definire il concetto di fondi mutualistici. Essi sono considerati come strumenti giuridici di gestione del rischio in agricoltura e sono stati introdotti dal legislatore europeo nel 2009, sebbene in certi paesi, come Italia, Francia e Olanda essi fossero gi? da tempo utilizzati in base alle rispettive normative nazionali. La loro natura giuridica permette ad un gruppo di produttori (gli agricoltori - membri dei fondi) di dividere il rischio di produzione. L?obiettivo dei fondi ? quello di coprire la perdita di reddito usando il capitale del fondo, il che permette agli agricoltori di compensare la perdita economica causata da eventi specifici. Attualmente l?ordinamento dell?Unione europea prevede solo alcune regole generali sui fondi mutualistici e di conseguenza spetta agli Stati membri dettare norme di dettaglio. L?introduzione del concetto di fondi mutualistici in Polonia potrebbe produrre sia benefici assicurativi che alcuni effetti sociali in agricoltura
