Abstract

Sotto il profilo giuridico, l?accesso alla propriet? della terra si pone oggi in termini molto diversi dal passato: esso ? presupposto per godere dei valori ambientali che la terra esprime, ? condizione di un pi? generale godimento della natura e del paesaggio, ma ? anche espressione della consapevolezza e della responsabilit? che noi abbiamo verso la terra e verso le generazioni future. La terra reclama diritti attraverso usi sostenibili, atteggiamenti responsabili, valori ideali, comportamenti solidali. ? necessario pertanto un nuovo patto sociale tra l?uomo e la terra, che regoli anche i diritti di quest?ultima. ? questo il compito dei giuristi, soprattutto di quelli di diritto agrario: ? necessario, costruire pi? adeguate strumentazioni per modificare l?ordinamento in funzione di un nuovo orizzonte strategico dell?agricoltura e per assicurare la sopravvivenza dell?umanit?.
