La orientación sexual y la identidad de género: desde la mirada del sistema interamericano de derechos humanos

Abstract

Los derechos de las personas en el orbe mundial deben estar garantizados, los países deben entender que los derechos -en general- de todas las personas no deben negociarse, y no debe permitirse que estos derechos sean difuminados. Por lo tanto, la persona que detenta para sí una orientación sexual y una identidad de género diversa al resto de la población, es persona y le deben ser reconocidos sus derechos como cualquier otra. De lo anterior se desprende que, los derechos de la persona que detenta para sí una orientación sexual y una preferencia de género, deben ser respetados sin discriminación. Lo anterior, bajo interpretación extensiva del texto de la Convención Americana de Derechos Humanos (más adelante, CADH) en donde se encuentra reconocida la identidad de género.
