Procuraduría de Protección al Consumidor, ineficaz defensora de derechos fundamentales en México

Abstract

En el presente trabajo, analizaremos en primer lugar, el nivel de derecho fundamental que debe prevalecer en la protección a los consumidores finales en México, en segundo lugar, la erosión que el comercio en la red ha causado a la vieja pirámide de Kelsen y su inevitable derrumbe, perdiendo la constitución su lugar como norma primordial, a la luz del nuevo orden jurídico internacional, concluiremos, analizando las medidas a favor de los consumidores que realiza, la llamada Procuraduría de Protección al Consumidor (PROFECO), para determinar su eficacia o no, en la defensa de derechos fundamentales.
