La Clasificación De Las Empresas Por Su Solvencia En El Rd 3/2011 De 14 De Noviembre Del Tr De La Ley De Contrataciones Públicas: Relación Con El Principio De Igualdad

Abstract

En España, la regulación que establece el Texto Refundido de la Ley de Contratos Públicos, 3/2011 de 14 de noviembre se ajusta a la jurisprudencia del Tribunal de Justicia de la Unión Europea en lo que al principio de igualdad de trato entre nacionales y extranjeros se refiere. Por ende, se podría afirmar que no existe discriminación en función de la nacionalidad de los empresarios que intervienen en un contrato del sector público español. No obstante, ¿por qué los empresarios españoles están sujetos a un régimen más estricto que los comunitarios? En este trabajo se establecerán las premisas jurídicas y teóricas sobre este planteamiento.
