El Privilegio Del Agricultor Como Límite A Los Derechos Del Obtentor En El Sistema Cupov: Especial Referencia Al Caso Mexicano

Abstract

En este trabajo abordamos el estudio de una de las excepciones más importantes en el sistema de protección de obtenciones vegetales: el privilegio del agricultor. Este consiste en la posibilidad de que los agricultores siembren el producto de la cosecha para obtener nuevos cultivos empleando variedades vegetales protegidas sin pagar regalías. Esta excepción se estableció de manera explícita en el Acta de 1991 del Convenio Internacional para la Protección de Obtenciones Vegetales (CUPOV) con ciertas limitaciones. Paradójicamente su regulación en la Ley Federal de Variedades Vegetales (LFVV) es en extremo deficiente teniendo en cuenta la existencia en México de un sistema de producción tradicional en la agricultura.
