El Marco Regulatorio De La Casa Hogar En San Luis Potosí, Los Principios Generales Y Su Regulación Jurídica

Abstract

El trabajo que se presenta a continuación es un breve repaso de los principios generales que rigen a la Casa Hogar y su positivación en el ordenamiento jurídico nacional y potosino. El punto de partida será el concepto de Casa-Hogar y sus fundamentos constitucionales y legales. Posteriormente se estudiará la tutela, el asistencialismo y el interés superior del menor. Respecto de los cuales se analizará su concepto sociológico e histórico para luego proceder a estudiar aspectos regulatorios. El análisis de los principios no será únicamente legal, sino que se citará jurisprudencia de tribunales sobre la aplicación de estos principios. El lector encontrará en este trabajo una valiosa introducción al estudio legal de la Casa-Hogar.
