Tanteo y retracto legales vs convencionales. Retos en Cuba

Abstract

Desde una perspectiva histórica, doctrinal y comparada la presente investigación, motivada por las deficiencias en la legislación civil nacional respecto a la regulación de los derechos de adquisición preferente, fundamenta la necesaria modificación de la Ley No. 59/87 a fin de contribuir al perfeccionamiento del ordenamiento jurídico vigente, en correspondencia con las posiciones modernas de la dogmática civil y el actuar de los operadores del Derecho. Se ilustran los antecedentes históricos, sistematización de los aspectos doctrinales y una valoración de la regulación civil de estos derechos (tanteo, retracto y opción) en el derecho comparado. Realizamos la reseña histórica del tanteo y del retracto en el marco nacional, acompañado de su regulación civil y administrativa actual.
