Las medidas cautelares en el procedimiento civil ecuatoriano

Abstract

El presente artículo se analiza el procedimiento de las medidas cautelares en el procedimiento civil ecuatoriano. Las medidas cautelares son instrumentales por cuanto no tienen fin en sí mismas, constituyen un accesorio de otro proceso principal del cual dependen, y, a la vez, aseguran el cumplimiento de la sentencia que vaya a dictarse. Las medidas cautelares se pueden solicitar antes o después de planteada la demanda. Tienen por objeto asegurar los bienes o mantener las situaciones de hecho existentes al tiempo de interposición de la demanda y preservar el cumplimiento de la sentencia que recaiga, en definitiva, el fundamento de toda medida cautelar es mantener la igualdad de las partes en el litigio, evitando que se conviertan en ilusoria la sentencia.
