Abstract

O presente trabalho está consubstanciado numa análise acerca da aplicação dos princípios com base nos valores trazidos pelo pós-positivismo para a Teoria Geral do Direito. O estudo concentra-se em contrastar as formas de aplicação dos princípios propostas por Robert Alexy com a apresentada por Humberto à vila, a fim de identificar se as teorias desenvolvidas pelos autores são conflitantes.
