Histórico da penalização no Brasil e a inconstitucionalidade da redução da maioridade penal

Abstract

Este artigo objetivou relatar como base o histórico da aplicação da pena para crianças e adolescentes autores de infrações no Brasil. Após rápida apresentação dos fatos adentra-se na temática da determinação da faixa etária da maioridade penal no Brasil e a impossibilidade de sua redução por meio do Projeto de Emenda Constitucional – PEC – n. 171 de 1993 por ser inconstitucional. Por fim são exploradas as formas de responsabilização de adolescentes que cometem ato infracional, são as chamadas de medidas socioeducativas.
