La protección jurídica internacional a los derechos de las niñas y los niños. Cuba, punto de partida a la protección a nivel mundial

Abstract

La presente investigación está estructurada en dos capítulos. El primero está dirigido a establecer cuál es el respaldo jurídico internacional a las niñas y los niños, su surgimiento y las regulaciones en las legislaciones contemporáneas, se divide en tres epígrafes. El primero está encaminado a establecer el surgimiento histórico del respaldo jurídico a los derechos de las niñas y los niños. El segundo plantea las definiciones de los derechos reconocidos en la Convención de los Derechos del Niño (CDN) y el tercer epígrafe dedicado a como se manifiestan estos en las legislaciones foráneas. El segundo capítulo se encarga de establecer cuáles son las violaciones de los diferentes derechos reconocidos en la CDN y el papel de Cuba en la protección de la infancia, y se encuentra estructurado en tres epígrafes. El primero de ellos establece los organismos y normativas internacionales relacionados a la infancia, dirigido a demostrar la existencia de diferentes mecanismos protectores de la niñez. El segundo epígrafe se encarga de establecer las diferentes violaciones a los derechos reconocidos en la CDN y el tercero a demostrar como Cuba constituye una referencia de gran importancia en la protección de este sector vulnerable.
