Administración de justicia constitucional en el estado ecuatoriano

Abstract

La sociedad ecuatoriana, desde su nacimiento como república independiente, ha pasado por tres períodos constitucionales que resaltan unos de otros: poscolonial; liberal; y, neoliberal, con una derivación social demócrata. La primera, en la cual se mantiene las características de la sociedad feudal europea traspalada a la nuestra; la segunda, la presencia del estado liberal en base al reconocimiento de libertades fundamentales, donde se maximiza al individuo versus el estado; la tercera, aparece el estado como uno de los actores fundamentales del quehacer social en diversas áreas, atenuando de esta forma los abismos que creó el sistema liberal a partir de la incorporación de derechos sociales y obligaciones estatales básicas, además de asignar al estado la propiedad y gestión sobre ciertos bienes y servicios considerados estratégicos.
