Derecho de participación del niño en el marco de instituciones jurídicas familiares protectoras de sus derechos

Abstract

El derecho de participación, traducido esencialmente en la posibilidad real de que el niño sea escuchado, resultarían meros postulados teóricos, desprovistos de verdadera utilidad, si se analizaran únicamente dentro de las barreras normativas de la Convención de los Derechos del Niño (CDN). En tal sentido, se impone una reflexión sobre la materialización que pueda tener la dogmática del infante en las instituciones sustantivas y procesales, que son en definitiva las que protegen jurídicamente la persona del niño. En fin, si bien la CDN se sitúa como una especie de Derecho Supranacional para los Estados Partes, solo los códigos civiles y de familia, complementados con la legislación adjetiva correspondiente, podrán hacer efectivos los derechos del niño.
