La inexigibilidad de la responsabilidad como un caso en el que no se ha de exigir responsabilidad penal

Abstract

La culpabilidad como categoría jurídico penal y las condiciones normales de exigibilidad como elemento integrante de esta, requiere que el sujeto para que pueda responder penalmente, ha de ser culpable. Con relación a dicho particular no existe claridad en cuánto a qué se debe considerar por dicha institución, así como qué la ha de caracterizar, en tanto la conducta ha de ser exigible. Motivos por lo que urge adentrarse en el tema.
