Contexto histórico del surgimiento y aplicación de la tercerización. Reflexiones sobre el caso de Venezuela

Abstract

La tercerización ha sido una de las formas en las que la fuerza de trabajo asalariada es explotada dentro del sistema capitalista. El surgimiento, desarrollo y evolución de las relaciones de trabajo tercerizadas durante las dos últimas décadas de siglo XX obedeció a circunstancias históricas especificas de carácter internacional y nacional. A través de esta práctica se ha incrementado la tasa de ganancia en determinas ramas y sectores de la economía, al mismo tiempo que la clase trabajadora ha visto afectada sus condiciones laborales. Desde 2012 el nuevo marco legal vigente en Venezuela prohíbe el empleo de la tercerización por considerarla un fraude o simulación de la relación laboral; en ese sentido la Ley otorgó un plazo de tres años para que las empresas se adecuen. Sin embargo, el camino a la erradicación va más allá de un postulado legal; por tal razón es necesario establecer los retos y perspectivas que se deben asumir.
