Rasgos de las modernas tendencias del Derecho Penal en el Código Penal cubano

Abstract

En el artículo el autor a partir de la breve caracterización del Derecho Penal del enemigo, simbólico y de la sociedad del riesgo, valora la presencia de sus rasgos en la legislación sustantiva penal cubana. Desde este diagnóstico critica los argumentos que se esgrimen para justificar dichas tendencias teórico-legislativas, que significan una clara expansión de la intervención punitiva de los Estados. Explica como de este modo el Derecho Penal se extiende a nuevos ámbitos y modifica la forma en que operaba en detrimento de sus principios garantistas. De esta forma, se presentan sintéticamente los contornos de una discusión que resulta importante para la doctrina penal en general y alerta sobre la necesidad de proteger conquistas alcanzadas luego de muchos años de lucha.
