Los menores en conflicto con la ley penal. Su regulación jurídica en el decreto ley 64 de 1982

Abstract

Al abordar el tema de los menores transgresores de la Ley Penal y su tratamiento jurídico pretendemos valorar no solo la importancia relevante de la protección en matera legal y todas sus perspectivas, sino también destacar la importancia de la acción de la comunidad con todas sus instituciones y especialmente el papel de la familia partiendo de la aplicación y el cumplimiento efectivo de todo lo regulado legalmente en materia de protección a la infancia y a la juventud. El fenómeno de la transgresión legal de los menores y la delincuencia juvenil se ha presentado en todas las formaciones sociales manifestándose de diferentes formas en correspondencia con el momento histórico concreto ,llegando hasta nuestros días con características actualizadas en sus manifestaciones .Nuestro sistema político ha creado un tratamiento diferenciado, donde se reconoce que el desarrollo saludable de los niños es fundamental para el bienestar actual y futuro de cualquier sociedad. Recientemente se reconocieron los derechos de los niños y las niñas y se ha recibido la aceptación de la Convención de los Derechos del Niño apreciándose aportes al Fondo de Naciones Unidas para la Infancia revitalizándose con ello su tarea.
