La convención de los derechos del niño y la niña: instrumento por excelencia para el reconocimiento social y legal de una infancia con derechos

Abstract

El artículo se refiere a la importancia social de la Convención de los Derechos del Niño y la Niña como instrumento jurídicamente vinculante para la construcción de un mundo apropiado para los niños, las niñas y los adolescentes. La autora ofrece un análisis reflexivo y crítico sobre el contenido de los derechos de la infancia, aunque reconoce la inexistencia de un consenso universal sobre lo que implica cada uno de ellos. Se enfatiza en la necesidad de conocer y reconocer cada derecho, destacando la importancia de decretar leyes que legalicen estas prerrogativas, unido al empleo de diferentes mecanismos sociales para la internalización acertada de estos derechos. Además, se demuestra la urgencia de repensar el contenido de este texto jurídico, referencia de gran valor social, para orientar los modos de actuación de los Estados Partes con respecto a la situación actual de la infancia en las naciones. Se concluye exhortando a la legitimación de los derechos de la infancia en la cotidianidad, y no meramente en las leyes.
