La perspectiva penal de la resocialización: su comportamiento histórico en Cuba

Abstract

El presente artículo realiza un recuento histórico del Derecho Penal en Cuba, matizado por una perspectiva que enfatiza en las cuestiones de carácter normativo criminal que han facilitado u obstaculizado la Resocialización a través de los principales períodos de la historia nacional. Se arriba a la conclusión de que la política penal en Cuba ha experimentado fluctuaciones constantes de un período a otro, lo que en consecuencia también ha provocado condiciones cambiantes en torno a las posibilidades que brinda la ley penal hacia la Resocialización del delincuente, aunque se aprecia que en la última década existe voluntad estatal para la imposición de sanciones y medidas no privativas de libertad así como de beneficios extrapenales en pos de la Resocialización.
