Legalidad vs. tipos penales abiertos en el código penal cubano

Abstract

En el presente trabajo, a partir de los retos que impone la sociedad moderna al Derecho Penal, se describen los riesgos y beneficios de la utilización por las legislaciones penales de los tipos abiertos como modalidad técnico legislativa para la conformación de las figuras de delito. Para ello se fundamentan las exigencias del principio de legalidad y realiza un análisis exegético que permite valorar la situación concreta del Código Penal cubano. Finalmente, el autor sostiene el criterio de la necesidad de recurrir a los tipos abiertos sólo en aquellos casos imprescindible a la vista de las necesidades de tutela del bien jurídico que se desea proteger.
