Cuba: una temprana arquitectura constitucional para la independencia

Abstract

El proyecto de Constitución redactado por el abogado bayamés Joaquín Infante para la conspiración independentista de Román de La Luz, constituye un documento particularmente interesante en la historia constitucional cubana. Una de las características más señaladas en este sentido ha sido, precisamente, su singular opción independentista en un entorno político marcado por la vocación asimilista de la generalidad de la élite criolla. Sin embargo, uno de los elementos más sobresalientes del mismo reside en la particular combinación de herramientas y principios constitucionales típicos de la época, en una arquitectura constitucional particularmente atípica. El análisis de la interpretación y sentido conferidos en la misma al modelo de separación de los poderes, así como al lenguaje de los derechos individuales empleados por su autor, conforman el núcleo del presente artículo.
