Protección Integral de las Niñas y Niños

Abstract

En los últimos tiempos se ha tenido muy en cuenta los derechos fundamentales del niño, y más aún después de la entrada en vigor de la Convención Internacional sobre los Derechos del Niño, donde se ha hecho importante velar por la aplicación del principio del interés superior del menor, y precisamente, el derecho del niño a ser escuchado, como uno de los principales derechos que se deben tener en cuenta para determinar dicho principio en una situación concreta, sería factible utilizarlo en la Mediación Familiar como método alternativo de solución de conflictos familiares, debido que en una crisis familiar, fundamentalmente en la separación o divorcio, donde hay que determinar quién se queda con la guarda y cuidado del menor y a quién le corresponde el régimen de comunicación, se necesita de ayuda y orientación, por lo que resultaría aceptable la Mediación Familiar para eso, donde se les ayuda a resolver sus problemas y tener en cuenta las cuestiones del menor y su opinión con relación al conflicto.
