La atipicidad de la operación del contrato de Factoring y su necesidad de regularlo

Abstract

Entre las necesidades económicas surge el Contrato de Factoring como un instrumento de colaboración empresarial que ha ocupado un papel importante en el desarrollo de la actividad comercial por su alternativa como herramienta jurídica para el desarrollo económico. El contrato de factoring ofrece algunos tipos de servicios tanto administrativos como financieros y judiciales, estos comprenden en lo principal, la gestión y cobro de los documentos crediticios cedidos por el acreedor y aceptado por el factor, el cual asume, en las cláusulas contractuales, el riesgo de incumplimiento e insolvencia de los deudores.
