Orã Genes Del Reconocimiento Constitucional De Los Derechos Humanos: Defensor Civitatis Y Medio Ambiente

Abstract

Con la realización del presente trabajo, pretendemos investigar cuáles son los antecedentes históricos que conforman los derechos humanos y fundamentales reconocidos actualmente en nuestra Constitución española de 1978. En este sentido, tomaremos como punto de partida el origen y evolución hasta la Roma postclásica de la protección legal otorgada por el defensor civitatis, esto es, aquel defensor de la plebe cuya misión principal fue la tutela de los derechos de los ciudadanos romanos más desfavorecidos. Prestando, especial atención, al medio ambiente como bien jurídico protegido desde la Antigüedad hasta nuestra Constitución española (artículo 45).
