Genéricos y no genéricos: análisis microeconómico y propuesta de solución al dilema

Abstract

Este trabajo trata del dilema que se plantea en el mundo de la farmacopea entre genéricos y no genéricos y la fijación de precios. La empresas farmacéuticas y laboratorios se caracterizan porque son una estructura oligopolística donde se investiga nuevos principios activos, nuevas moléculas, bajo patentes otorgadas por las administraciones sanitarias; también porque presentan costes decrecientes merced a las cuantiosas inversiones iniciales para conseguir nuevos fármacos que lanzar al mercado. Ambas características –patentes y costes decrecientes- originan dificultades insalvables si se deja a las empresas operar libremente en el mercado porque se cae en el dilema de elegir entre la producción con eficiencia, la viabilidad empresarial o un coste fiscal. En este trabajo se aporta una solución mediante un órgano regulador de carácter público que opere con reglas precisas que se enumeran en el último epígrafe y que intentan dar satisfacción a las partes.
