Abstract

O presente trabalho apresenta à discussão acadêmica e à sociedade o novo conceito ou técnica de julgamento consistente no Estado de Coisas Inconstitucional (ECI), originário da Corte Constitucional Colombiana. Adotando-se a metodologia de pesquisa bibliográfica, investigaremos as condições de sua declaração à luz do ativismo estrutural judicial estrutural dialógico, como forma de verificar a viabilidade jurídica para sua aplicação no sistema carcerário brasileiro.
