Abstract

O estudo da Usucapião Familiar como norma recente que merece ser aprofundado. Primeiramente são abordados os aspectos gerais sobre as varias modalidades, destacando-se alguns aspectos deste instituto jurídico. Em seguida é tratado especificamente acerca da Usucapião Familiar. É abordada a Lei que originou o artigo que foi acrescido ao Código Civil Brasileiro, trazendo também suas peculiaridades, finalidade e também as polêmicas que giram em torno do tema. Por último é considerada a possibilidade da aplicação da Usucapião Familiar em Uniões Homoafetivas.
