A Possibilidade De Ampliação Da Licença-Paternidade Através Da Arguição De Descumprimento De Preceito Fundamental

Abstract

O objetivo principal do presente trabalho é analisar a razoabilidade da distinção temporal entre as licenças maternidade e paternidade nos casos de adoção. A Constituição Federal promove diferenciação entre as licenças motivada por razões e necessidades de cunho biológico, no entanto, em casos de filiação adotiva inexistem fatores biológicos e, portanto as necessidades afetivas deveriam prevalecer. A Lei n. 10421/2002 e o RGPS mantinham a mesma diferenciação dos casos biológicos aos casos adotivos. A proposta da pesquisa é estudar a distinção das licenças diante do princípio da igualdade bem como, analisar se a recente Lei n. 12.873/2013 promove efetiva isonomia de direitos entre os gêneros quanto à licença e ao salário-maternidade.
