Mecanismos De Vinculação Das Decisões Judiciais No Direito Brasileiro: Repercussão Geral, Súmula Vinculante E Súmula Impeditiva De Recurso

Abstract

O presente artigo realiza uma análise de alguns mecanismos de vinculação das decisões judiciais, se adequando, portanto, ao campo da Ciência Social aplicada jurídica. Primeiramente se abordou o pano de fundo jurídico-social em que se desenvolveram tais institutos jurídicos, para posteriormente analisar os mecanismos da repercussão geral, súmula vinculante e súmula impeditiva de recurso (de apelação). Além dos mecanismos em si, outros aspectos essenciais para sua compreensão foram discutidos. Para embasar tal estudo utilizou-se moderna doutrina, e normas do Código de Processo Civil brasileiro e da Constituição da República Federativa do Brasil de 1988. Conclui-se que tais mecanismos são capazes de auxiliar o Poder Judiciário a superar a sua crise, advinda, entre outros fatores, do excessivo número de demandas a serem julgadas. Todavia, para tanto, precisam ser bem entendidos e utilizados pela comunidade jurídica.
