Responsabilidad Del Estado Y De Los Funcionarios Públicos En El Marco Jurídico Venezolano

Abstract

En el presente trabajo de carácter documental se ha utilizado la técnica del análisis y la argumentación para determinar desde el punto de punto doctrinario y jurisprudencial la Responsabilidad del Estado y los Funcionarios Públicos en el marco del ordenamiento jurídico venezolano. Se trata de abordar la responsabilidad del Estado como la obligación que pesa sobre éste de reparar los daños causados por el hecho ilícito de sus órganos. La responsabilidad del Estado se basa en el principio de que todo daño causado ilícitamente por él, debe ser reparado de buena fe, y la responsabilidad de los funcionarios públicos, está demarcados en la Constitución de la República Bolivariana de Venezuela (2000) y están fundamentados en los principios de honestidad, participación, celeridad, eficacia, eficiencia, transparencia rendición de cuentas y responsabilidad del funcionamiento en el ejercicio de su función pública.
