Abstract

La Autonomía de la voluntad privada comprende la capacidad del individuo de actuar de acuerdo a sus propias normas. Es un principio que rige en el Derecho Civil en general, y en el Derecho Sucesorio como rama dependiente del mismo a pesar de poseer sus propios principios. Es innegable la necesaria relación que existe entre el Derecho Civil y el Derecho Constitucional como rama rectora dentro del Ordenamiento jurídico, donde la Constitución como Carta Magna regula el Derecho de Herencia sobre la vivienda y determinados bienes que conforman la propiedad personal como un derecho inalienable de los ciudadanos, al igual que otros como los inherentes a la personalidad, los familiares, el de los consumidores, etc.
