La Responsabilidad Civil Derivada Del Delito A Favor De Personas Jurídicas. Problemas Actuales

Abstract

La investigación fundamenta la necesidad de estudiar con profundidad las limitaciones legislativas sobre responsabilidad civil a favor de personas jurídicas, el incumplimiento que esto provoca en uno de los pronunciamientos de las sentencias penales y la afectación que recibe la economía nacional por este concepto. El trabajo se estructuró en dos capítulos; en el primero se abordan aspectos generales y doctrinales, una visión a su tratamiento en el derecho comparado y su aplicación y ejecución en Cuba. En el segundo capítulo se tratan las principales problemáticas legislativas en Cuba en torno a la responsabilidad civil a favor de personas jurídicas, y la afectación que provoca en la economía nacional, el no cumplimiento de lo dispuesto al respecto en sentencias penales. Se analiza la situación presentada durante el año 2009 en el municipio de Las Tunas. Se utilizó en el trabajo los métodos: Análisis Histórico, Teórico jurídico, Análisis Jurídico Comparado, revisión documental y entrevistas, para así arribar a las conclusiones que motivaron las recomendaciones formuladas, donde se aboga por la necesidad de crear normas jurídicas que regulen un procedimiento efectivo y ágil.
