Valoraciones Teórico Jurídicas En Torno Al Delito De Estafa Por Omisión

Abstract

La acción y la omisión constituyen modalidades del actuar de un sujeto toda vez que están orientadas a un fin determinado y sometida por la voluntad dirigente. Se distinguen en el ámbito jurídico-penal por su relación con el perjuicio del bien jurídico protegido en la ley penal. La comisión daña al bien jurídico mediante una actividad corporal perceptible en el mundo exterior y la omisión a través de una inactividad corporal. El delito de Estafa, a pesar de que sus elementos distintivos exigen del sujeto activo un hacer, existe parte de la doctrina que estima que el mismo puede darse por omisión. No existe un consenso en relación al tema, por ello la investigación responde la problemática planteada.
