Abstract

La presente ponencia titulada "La hermenéutica contractual. Apuntes doctrinales y jurisprudenciales necesarios para su aplicación en el contexto jurídico cubano" aborda un tema novedoso y de gran actualidad en virtud de la protección cada vez mayor que recibe en nuestro ordenamiento la concertación y celebración de los contratos. No obstante, en muchos casos las partes no se ponen de acuerdo sobre el alcance y significado sobre las estipulaciones que establecieron en el contrato que celebraron, donde lo pactado se vuelve obligatorio para las partes en virtud de su propia voluntad. Por ello, desentrañar la verdadera intención de las partes cuando realizaron el contrato es tarea que presenta múltiples dificultades y donde la interpretación juega un papel primordial. Interpretar la voluntad de las partes, es, sin duda, una garantía del principio de conservación del contrato, así el negocio surtirá los efectos que realmente previeron y desearon las partes al momento de su concertación.
