Las Represalias Como Circunstancia Que Excluye La Ilicitud Del Hecho Internacional Cometido Por El Estado

Abstract

Las contramedidas constituyen un elemento de un sistema descentralizado por el cual los Estados al ver lesionado algunos de sus derechos pueden buscar la vindicación de los mismos y la restauración de la relación jurídica con el Estado responsable, que se ha roto por el hecho internacionalmente ilícito. Las mismas no entrañan el uso de la fuerza y serán adoptadas en forma que no impidan la reanudación del cumplimiento de las obligaciones quebrantadas por la contramedida, además de ser esencialmente temporales y reversibles. El Proyecto de artículos de la CDI acepta la figura de las contramedidas, pero a cambio dispone que se deben efectuar con moderación, estableciendo límites y condiciones a su ejercicio, con el objeto de lograr un equilibrio entre la aceptación de las contramedidas y la conveniencia de evitar abusos en su aplicación.
