El Debido Proceso: Una Mirada Desde La Perspectiva Del Juez Cubano

Abstract

Un Estado de Derecho que se precie de serlo tiene hoy en el Debido Proceso no solo un paradigma para su positivización de la Justicia, sino un reto diario perenne en su defensa y fortalecimiento, pues no basta solo con que las garantías que lo conforman estén presentes en las normas jurídicas: se precisa de operadores del derecho comprometidos de manera permanente con los principios que lo componen. Es así que la historia del Debido Proceso, los principios fundamentales del mismo, la manifestación de los éstos en las leyes penales cubanas, y hasta las deficiencias y aspectos susceptibles y urgidos de perfeccionamiento en las mismas, son aspectos a los que no puede estar ajeno el Juez penal cubano de hoy, en su búsqueda del recto camino hacia la Justicia que imparte en nombre del pueblo al que pertenece.
