Los Elementos Teóricos Para Establecer La Peligrosidad Social Del Hecho

Abstract

Desde el surgimiento del término peligrosidad social, las controversias en torno a su denominación no han cesado. Unos la conciben como la tendencia de un individuo para delinquir y la materializan en la imposición de medidas de seguridad. Cuba es heterogénea en este sentido, se apropia de esta institución al heredarla del antiguo campo socialista, estableciéndola como rasgo esencial del concepto material del delito y como inclinación de una persona para cometerlo. En la práctica los criterios para establecer la peligrosidad social del hecho son diversos, no existiendo homogeneidad en los pronunciamientos realizados por el órgano jurisdiccional, instrucción y la doctrina.
