Abstract

El artículo a disposición desarrolla un estudio teórico doctrinal de la capacidad, haciendo hincapié en la figura de la capacidad restringida de los menores de edad a partir de la importancia de reconocer a los mismos como plenos sujetos de derecho, merecido reconocimiento que logró incorporar la Convención sobre los Derechos del Niño. Específicamente se ahonda en la problemática, para que se reformule el derecho positivo en este sentido y los menores de edad con capacidad restringida en Cuba, logren ejercitar determinados derechos, teniendo en cuenta su capacidad natural.
