Impacto De Las Lagunas Jurídicas En La Plenitud Del Ordenamiento Jurídico

Abstract

La presente investigación aborda un tema novedoso y de gran importancia para la plena aplicación del Derecho. El Derecho constituye un sistema que requiere de tres rasgos fundamentales para su eficacia, la unidad, la coherencia y la plenitud. Estos presupuestos se ven afectados por aquellas imperfecciones legislativas, o vacíos normativos denominados lagunas legales, donde a pesar de su existencia, los operadores del Derecho están en la obligación de solucionar basándose en el principio de non liquet. En la investigación se realiza un estudio teórico doctrinal sobre todas las definiciones, supuestos, causas y efectos de las lagunas jurídicas y de su incidencia en la plenitud y coherencia del ordenamiento jurídico.
