Abstract

Diferentes países como España, Estados Unidos, Alemania, Italia, Francia Inglaterra y Portugal han sido objeto de análisis en este artículo en relación al comportamiento y regulación del Principio de Publicidad en el Proceso Penal, en el cual se puede apreciar que en la mayoría de estos, las constituciones no regulan dicho principio de forma expresa como derecho fundamental, sino que lo establecen en sus códigos procesales, viéndose afectado su adecuada implementación y reconocimiento. A diferencia del ordenamiento Español, que el principio de publicidad de los juicios goza de un reconocimiento constitucional.
