La Enfermedad Mental Como Causa De La Disminución Sustancial De La Capacidad De Culpabilidad En El Derecho Penal Cubano

Abstract

La capacidad de culpabilidad o imputabilidad constituye uno de los elementos de la culpabilidad. Existen supuestos en que la capacidad de culpabilidad de una persona no se encuentra excluida, sino que ha disminuido notablemente afectándose las facultades intelectivas y volitivas. El ordenamiento jurídico cubano a pesar de que la regula no contiene los fundamentos teóricos que permiten identificar las causas y requisitos que deben apreciarse para su valoración. Por ello la investigación tiene como objetivo determinar las causas y requisitos que permiten establecer cuándo la capacidad de culpabilidad en un sujeto activo durante la ejecución de un delito se encuentra disminuida debido a que presenta una enfermedad mental y por tanto no puede comprender el alcance de su acción o dirigir su conducta.
