Comentarios Sobre El Sistema Inquisitivo Y El Sistema Acusatorio: Camino A Los Juicios Orales

Abstract

La presente investigación hace una comparación de los distintos sistemas jurídicos que existen mayormente en el mundo, hablamos del sistema inquisitivo proveniente de la familia romana y del sistema acusatorio naciente en el common law, haciendo especial mención de las fallas presentes en el sistema inquisitivo que hasta ahora había dirigido la justicia en México, las consecuencias dañinas que ha traído a la sociedad mexicana, el descontento de la comunidad, la impunidad, y la falta de protección de los derechos del procesado. Por otro lado, a la hora de describir al sistema acusatorio, se intenta hacer hincapié en los beneficios que trae a las partes que integran algún juicio, y no solo a las partes que intervienen, sino a la comunidad en general, la aceptación de sus procedimientos en la sociedad y la salvaguarda de las garantías del imputado.
