El Daño: ¿Común Denominador De La Responsabilidad Contractual Y La Extracontractual?

Abstract

La Responsabilidad civil data del Derecho Romano y ha trascendido hasta nuestros días, dirigida esencialmente a proteger a las víctimas de daños, sean éstos contractuales o extracontractuales. Desde esa óptica en la doctrina científica más moderna se analiza la Responsabilidad civil a partir de lo que se ha denominado "Derecho de daño". La existencia del daño se hace necesaria en el momento de declarar la responsabilidad civil pues éste constituye un requisito básico para proceder a pedir la indemnización de daños y prejuicios. De esta forma, todo daño material o moral siempre que sea real y esté demostrado da lugar a una responsabilidad ya sea de naturaleza contractual o extracontractual y a la consiguiente reparación
