Análise Sobre A (In) Constitucionalidade Da Lei Ficha Limpa No Brasil

Abstract

La investigación fue realizada por medio de la técnica bibliográfica, teniendo en cuenta por objeto la Ley Ficha Limpia brasileña. El objetivo del trabajo fue investigar la (in) constitucionalidad de esta Ley, resaltando el contexto que envuelve y el desrespecto, o no, de garantías y principios constitucionales. Para ello, se ha utilizado el método de abordaje inductivo y el método de procedimiento monográfico. En este sentido, se ha trabajado la idea de la ciudadanía y consciencia política, el contexto de la creación de la Ley y su evolución, bien como los problemas resultantes de su aplicación. Así, se ha verificado una serie de principios y garantías que fueron desrespectadas por la publicación de la Ley Ficha Limpia, produciendo, de esta forma, una exacerbada inseguridad jurídica.
