La Relación Derecho-Moral En Los Fundamentos Del Iuspositivismo

Abstract

En el trabajo abordamos el estudio relación entre el Derecho y la Moral en el positivismo jurídico, para lo cual partimos del análisis de las tesis que definen a esta corriente doctrinal del pensamiento jurídico, valorando sus verdaderos fundamentos y, sobre esta base y valiéndonos de los propios criterios de destacados representantes de la misma, sustentamos nuestro punto de vista, que difiere de la interpretación nihilista que sostiene que el positivismo niega que pueda haber algún tipo de relación entre las normas morales y las jurídicas.
