El Contrato De Seguro Marítimo. Su Expresión En Las Embarcaciones De Recreo De La Sucursal Marlin S.A. Jardines Del Rey

Abstract

Con el objetivo de eliminar las consecuencias perjudiciales de distintos fenómenos naturales, que aún con el nivel que actualmente ha alcanzado el desarrollo de la ciencia y la técnica son en ocasiones difíciles o imposibles de prever o evitar, surge el sistema de seguros. Su esencia consiste en crear medios especiales de reserva, que puedan cubrir el daño material, causado principalmente por fenómenos naturales y otros fenómenos nocivos, las organizaciones y las personas naturales, por medio de descuentos sistemáticos de sus medios, crean fondos de reserva, que se encuentran a disposición de organizaciones especiales de seguro. El seguro no elimina el daño sino que tolera que sus consecuencias resulten transferidas (trasladadas) por el sujeto amenazado por un evento económicamente desfavorable, a otro (asegurador) que, a esos fines, ha constituido una mutualidad especialmente preparada para absorber el riesgo de indemnización
